由于澳大利亞國人對(duì)人類基本權(quán)利的重視，每年的移民接收配額中都有一個(gè)很大的比例是給予澳大利亞公民或永久居民的配偶的。在移民法中，配偶的界定并非以一紙婚書作為標(biāo)準(zhǔn)，而是看男女雙方有沒有實(shí)質(zhì)上的夫妻親密關(guān)系。因此，配偶簽證可分為：訂婚配偶類、已婚配偶類、未婚同居類。
V300類是同居配偶類臨時(shí)居留簽證；
V309類是在澳大利亞境外提出申請(qǐng)的已婚配偶類臨時(shí)居留簽證；
V100類是在澳大利亞境外提出申請(qǐng)的，已婚配偶類永久居留簽證；
V820類是在澳大利亞境內(nèi)提出申請(qǐng)的，已婚配偶類永久居留過渡簽證；
V801類是在澳大利亞境內(nèi)提出申請(qǐng)的，已婚配偶類永久居留簽證；
配偶移民配額每年約500個(gè)。對(duì)申請(qǐng)人本身?xiàng)l件的要求不像技術(shù)移民（需要學(xué)歷和專業(yè)經(jīng)驗(yàn)）、投資移民（需要大筆資金及從商經(jīng)驗(yàn)）和父母移民（需要計(jì)算子女?dāng)?shù)目）等類別那樣嚴(yán)格。所以，它成為一條簡(jiǎn)單、直接和高效率的移民快捷方式。和所有其它西方國家移民*所面臨的問題一樣，配偶移民除了真正相親相愛締結(jié)的佳偶以外，也吸引了一些人以配偶結(jié)婚為手段實(shí)現(xiàn)一方獲利另一方移民的單純g的，這些人的夫妻或同居關(guān)系有名無實(shí)，也因此引發(fā)澳大利亞移民*對(duì)配偶申請(qǐng)人的審批與控制，務(wù)求去偽存真，使實(shí)質(zhì)上有真實(shí)而持久親密關(guān)系的愛侶得以團(tuán)聚，也使有名無實(shí)的婚姻曝光。但是有時(shí)候，由于材料準(zhǔn)備的不足及沒有經(jīng)驗(yàn)，即使是真正的配偶也有被拒簽的可能。嚴(yán)格繁復(fù)的審批手續(xù)，使無論真假配偶移民的申請(qǐng)難度都很大。
類別和申請(qǐng)程序
一、已婚配偶
在申請(qǐng)人與澳大利亞公民或永久居民登記結(jié)婚后，就可以由后者提名，前者遞交配偶移民簽證申請(qǐng)。這類移民簽證申請(qǐng)有2個(gè)步驟：
如果申請(qǐng)成功，申請(qǐng)人首先會(huì)獲得一個(gè)為期2年的臨時(shí)居留簽證，在這2年時(shí)間內(nèi)，移民局評(píng)審配偶雙方是否共同生活在一種真實(shí)而持久的密切關(guān)系中。在澳大利亞境內(nèi)申請(qǐng)是V820類，在澳大利亞境外申請(qǐng)是V309類。
隨后，如果關(guān)系一直維持，則可以申請(qǐng)永久居留的配偶簽證。在澳大利亞境內(nèi)申請(qǐng)是801類，在澳大利亞境外申請(qǐng)是100類。
二、未婚夫妻
澳大利亞承認(rèn)沒有婚姻關(guān)系的同居男女也屬配偶。該類簽證要來申請(qǐng)人在遞交移民申請(qǐng)時(shí)已經(jīng)與配偶同居了至少12個(gè)月。這類移民簽證申請(qǐng)有3個(gè)步驟：
居住于海外的申請(qǐng)人，由其身為澳大利亞公民和永久居民的未婚夫/妻擔(dān)保，申請(qǐng)未婚配偶簽證。同時(shí)表明，您真誠希望和您共同居住的未婚夫/妻結(jié)婚。在簽證發(fā)出，申請(qǐng)人持簽證入境澳大利亞后，申請(qǐng)人會(huì)獲得一個(gè)為期9個(gè)月的未婚配偶臨時(shí)簽證。
在此期間必須和擔(dān)保配偶注冊(cè)結(jié)婚。
2年后轉(zhuǎn)為正式永久居留簽證。

申請(qǐng)配偶移民的基本條件
一、申請(qǐng)獲得兩年配偶臨居簽證的基本條件
1. 已婚夫妻類別:有計(jì)劃維持真實(shí)而長(zhǎng)久的配偶關(guān)系（ Your relationship is genuine and continuing）。這種關(guān)系的存在是批準(zhǔn)移民的關(guān)鍵條件。
2．同居夫妻類別:若是同居關(guān)系，該段關(guān)系在申請(qǐng)前已經(jīng)持續(xù)了12個(gè)月 （You and your partner have been in that relationship for the period of 12 months immediately preceding the date of application）.
3．未婚夫妻類別:雙方年滿18歲 （Both you and your fiancé must be aged over 18 years）;有資格在澳大利亞依法結(jié)婚；真誠的希望于擔(dān)保人登記結(jié)婚，并維持真實(shí)和長(zhǎng)久的婚姻關(guān)系；申請(qǐng)人于未婚配偶兩人相互認(rèn)識(shí)，而且相互了解 （You and your fiancé have met and are personally known to each other）。
二、獲得永久配偶簽證的基本條件（Basic requirements of awarding permanent spouse migration visa）
上述的已婚、同居和未婚類別，如果在2年臨居期滿后能夠滿足下列條件，則可以轉(zhuǎn)為永久居留簽證：
1．已申請(qǐng)并持有臨居簽證已超過2年（持未婚簽證者必須已登記結(jié)婚至少2年）；
2．擔(dān)保人的擔(dān)保維持有效（即配偶沒有撤去擔(dān)保）；
3．與擔(dān)保人保持真實(shí)而長(zhǎng)久的關(guān)系，共同生活；
4．擔(dān)保人的基本條件：
18歲或以上的通常在澳大利亞居住的澳大利亞公民或者永久居民（An adult（over 18）Australian citizen，Australian permanent resident usually resident in Australia）；
以配偶或未婚配偶身份擔(dān)保他人移民或被他人擔(dān)保移民澳大利亞沒有超過2次；而且，在過去的5年內(nèi)未曾以配偶或未婚配偶簽證擔(dān)保他人或被他人擔(dān)保移民澳大利亞；
沒有從澳大利亞政府領(lǐng)取金額的養(yǎng)老金、補(bǔ)貼（It is unlikely that your assure could provide an acceptable assurance of support if they have received the full rate of any pensions or allowances from Australian government during the past year）。
在配偶類簽證類別中，移民法一再地強(qiáng)調(diào)兩人必須維持真實(shí)而長(zhǎng)久的親密關(guān)系。因此，如果該段關(guān)系破裂，擔(dān)保人在臨時(shí)簽證的2年期限內(nèi)撤回?fù)?dān)保，則申請(qǐng)人將無法獲得永久居留簽證。
值得注意的一點(diǎn)是，有關(guān)的法規(guī)雖然都訂立了嚴(yán)格的條件，但都有基于人道立場(chǎng)上的例外情況。例如，在涉及擔(dān)保人死亡、虐待配偶或雙方育有孩子等等情況下，申請(qǐng)人是可以不受擔(dān)保人撤回?fù)?dān)保的影響而依然獲得永久居留簽證的（Waiver of 2 Years Requirement）。
問與答
問1： 父母或他人包辦的婚姻可否通過審批？答： 可以，只要婚姻符合真實(shí)和持久關(guān)系這一種標(biāo)準(zhǔn)。
問2： 擔(dān)保人是否要提供經(jīng)濟(jì)擔(dān)保？答： 不一定。首先，作為申請(qǐng)人的配偶，擔(dān)保人是有義務(wù)保證申請(qǐng)人在澳大利亞境內(nèi)頭兩年的生活開支不會(huì)有問題。但是移民局也不一定要求擔(dān)保人出具經(jīng)濟(jì)擔(dān)保證明，如果移民局認(rèn)為有必要出具經(jīng)濟(jì)擔(dān)保證明時(shí)，擔(dān)保人配偶也不-定要兼做經(jīng)濟(jì)擔(dān)保人，而可以另外請(qǐng)人擔(dān)任此一角色。在此情況下，如果申請(qǐng)人在澳大利亞境內(nèi)的頭2年領(lǐng)取社會(huì)福利金的話，經(jīng)濟(jì)擔(dān)保人就有法律責(zé)任去償還該筆金額。
問3： 可以連同孩子一起申請(qǐng)嗎？答： 可以，只要孩子未滿18歲，未婚，在經(jīng)濟(jì)、生活和感情上依賴申請(qǐng)人，而且不會(huì)侵犯孩子另外一個(gè)家長(zhǎng)的撫養(yǎng)權(quán)就行。
問4： 非法移民能夠申請(qǐng)配偶簽證移民嗎？答： 能，但是申請(qǐng)表格一般要在澳大利亞境外遞交。若申請(qǐng)人與擔(dān)保人共有的兒女需要照顧或符合其它條件，則在澳大利亞境內(nèi)遞表也是可以的。
問5： 以前的婚姻關(guān)系未解決，可以申請(qǐng)配偶移民嗎？答： 可以。請(qǐng)參閱本章中同居配偶簽證的論述，一紙結(jié)婚證書并不是配偶移民簽證的審批標(biāo)準(zhǔn)。
問6： 可否跳過兩年的臨居等候期？答： 可以。但是必須滿足嚴(yán)格的臨居等候期豁免條件，即申請(qǐng)人與擔(dān)保人共同生活超過了5年，或在兩年等候期沒有屆滿以前孕育了子女等。

申請(qǐng)配偶移民的基本條件
一、申請(qǐng)獲得兩年配偶臨居簽證的基本條件
1. 已婚夫妻類別:有計(jì)劃維持真實(shí)而長(zhǎng)久的配偶關(guān)系（ Your relationship is genuine and continuing）。這種關(guān)系的存在是批準(zhǔn)移民的關(guān)鍵條件。
2．同居夫妻類別:若是同居關(guān)系，該段關(guān)系在申請(qǐng)前已經(jīng)持續(xù)了12個(gè)月 （You and your partner have been in that relationship for the period of 12 months immediately preceding the date of application）.
3．未婚夫妻類別:雙方年滿18歲 （Both you and your fiancé must be aged over 18 years）;有資格在澳大利亞依法結(jié)婚；真誠的希望于擔(dān)保人登記結(jié)婚，并維持真實(shí)和長(zhǎng)久的婚姻關(guān)系；申請(qǐng)人于未婚配偶兩人相互認(rèn)識(shí)，而且相互了解 （You and your fiancé have met and are personally known to each other）。
二、獲得永久配偶簽證的基本條件（Basic requirements of awarding permanent spouse migration visa）
上述的已婚、同居和未婚類別，如果在2年臨居期滿后能夠滿足下列條件，則可以轉(zhuǎn)為永久居留簽證：
1．已申請(qǐng)并持有臨居簽證已超過2年（持未婚簽證者必須已登記結(jié)婚至少2年）；
2．擔(dān)保人的擔(dān)保維持有效（即配偶沒有撤去擔(dān)保）；
3．與擔(dān)保人保持真實(shí)而長(zhǎng)久的關(guān)系，共同生活；
4．擔(dān)保人的基本條件：
18歲或以上的通常在澳大利亞居住的澳大利亞公民或者永久居民（An adult（over 18）Australian citizen，Australian permanent resident usually resident in Australia）；
以配偶或未婚配偶身份擔(dān)保他人移民或被他人擔(dān)保移民澳大利亞沒有超過2次；而且，在過去的5年內(nèi)未曾以配偶或未婚配偶簽證擔(dān)保他人或被他人擔(dān)保移民澳大利亞；
沒有從澳大利亞政府領(lǐng)取金額的養(yǎng)老金、補(bǔ)貼（It is unlikely that your assure could provide an acceptable assurance of support if they have received the full rate of any pensions or allowances from Australian government during the past year）。
在配偶類簽證類別中，移民法一再地強(qiáng)調(diào)兩人必須維持真實(shí)而長(zhǎng)久的親密關(guān)系。因此，如果該段關(guān)系破裂，擔(dān)保人在臨時(shí)簽證的2年期限內(nèi)撤回?fù)?dān)保，則申請(qǐng)人將無法獲得永久居留簽證。
值得注意的一點(diǎn)是，有關(guān)的法規(guī)雖然都訂立了嚴(yán)格的條件，但都有基于人道立場(chǎng)上的例外情況。例如，在涉及擔(dān)保人死亡、虐待配偶或雙方育有孩子等等情況下，申請(qǐng)人是可以不受擔(dān)保人撤回?fù)?dān)保的影響而依然獲得永久居留簽證的（Waiver of 2 Years Requirement）。
問與答
問1： 父母或他人包辦的婚姻可否通過審批？答： 可以，只要婚姻符合真實(shí)和持久關(guān)系這一種標(biāo)準(zhǔn)。
問2： 擔(dān)保人是否要提供經(jīng)濟(jì)擔(dān)保？答： 不一定。首先，作為申請(qǐng)人的配偶，擔(dān)保人是有義務(wù)保證申請(qǐng)人在澳大利亞境內(nèi)頭兩年的生活開支不會(huì)有問題。但是移民局也不一定要求擔(dān)保人出具經(jīng)濟(jì)擔(dān)保證明，如果移民局認(rèn)為有必要出具經(jīng)濟(jì)擔(dān)保證明時(shí)，擔(dān)保人配偶也不-定要兼做經(jīng)濟(jì)擔(dān)保人，而可以另外請(qǐng)人擔(dān)任此一角色。在此情況下，如果申請(qǐng)人在澳大利亞境內(nèi)的頭2年領(lǐng)取社會(huì)福利金的話，經(jīng)濟(jì)擔(dān)保人就有法律責(zé)任去償還該筆金額。
問3： 可以連同孩子一起申請(qǐng)嗎？答： 可以，只要孩子未滿18歲，未婚，在經(jīng)濟(jì)、生活和感情上依賴申請(qǐng)人，而且不會(huì)侵犯孩子另外一個(gè)家長(zhǎng)的撫養(yǎng)權(quán)就行。
問4： 非法移民能夠申請(qǐng)配偶簽證移民嗎？答： 能，但是申請(qǐng)表格一般要在澳大利亞境外遞交。若申請(qǐng)人與擔(dān)保人共有的兒女需要照顧或符合其它條件，則在澳大利亞境內(nèi)遞表也是可以的。
問5： 以前的婚姻關(guān)系未解決，可以申請(qǐng)配偶移民嗎？答： 可以。請(qǐng)參閱本章中同居配偶簽證的論述，一紙結(jié)婚證書并不是配偶移民簽證的審批標(biāo)準(zhǔn)。
問6： 可否跳過兩年的臨居等候期？答： 可以。但是必須滿足嚴(yán)格的臨居等候期豁免條件，即申請(qǐng)人與擔(dān)保人共同生活超過了5年，或在兩年等候期沒有屆滿以前孕育了子女等。
問7： 配偶移民申請(qǐng)者是否要面試？答： 有可能。如果移民局覺得有必要確認(rèn)兩人間的關(guān)系是否真實(shí)（及持久）的話，就會(huì)安排時(shí)間，通知雙方出席面試。通過對(duì)兩個(gè)人分別的問話，可以具體取得雙方的關(guān)系、家庭、日常生活和親密與否等情況，再以此做參考來證實(shí)兩人的關(guān)系。
